Terms and Conditions

These terms and conditions (“Agreement”) constitute a legally binding agreement between the Rhodes Centre for History and Social Research – Rhodes Project SCE, hereinafter referred to as “Provider,” and the individual or entity agreeing to these terms, hereinafter referred to as “User.” 

By accessing or using the facilities and services provided by the Provider, the User agrees to be bound by the terms and conditions outlined below:

  1. Definition:

The Provider under no circumstances or interpretation offers a tenancy to the User, but rather a prepaid license to access research infrastructures through the provided facilities and services.

  1. Facilities and Services: 

2.1 The Provider offers a variety of facilities and services, including, but not limited to, access to special software and hardware, access to research data, access to digitally and physically archived material, access to digital and physical library, workstations, internet access, printing, scanning, photocopying, video conferencing system, personal locker, and kitchen amenities.

2.2. Users are expected to use the facilities and services in a respectful and appropriate manner, avoiding any actions that may disrupt the work environment or infringe upon the rights of other Users.

  1. Usage plans:

3.1. Usage fees are publicly announced on the website of the Provider. 

3.2 The website of the Provider is the only official and authoritative source of information regarding the usage plans at any given time.  

3.3 The Provider is not bound by any public announcement of the respective usage plans on any website or webpage other than the official website of the Provider.

3.4 Users agree to select a plan based on their requirements and are responsible for understanding and abiding by the terms associated with their chosen plan.

3.5 Already purchased plans are non-transferable. The User who paid the plan is the only individual authorized to use the facilities and services under that plan.

3.6 The usage plans can be freely changed by the Provider. Already purchased plans are not affected.

  1. Fees and Payment:

4.1. Usage fees are publicly announced on the website of the Provider. 

4.2 The website of the Provider is the only official and authoritative source of information regarding the level of fees at any given time.  

4.3 The Provider is not bound by any public announcement of the respective fees on any website or webpage other than the official website of the Provider.

4.4 The levels of fees are subject to change from the moment of their public announcement on the official website of the Provider and are legally binding for any prospective User. 

4.5. Fees are payable at the commencement of the usage plan.

4.6 Failure to make timely payments may result in suspension or termination of usage plan.

5. Surcharges:

5.1 On the basis of the usage plan, the Provider surcharges the User as follows:

 5.1.1 Extra hours and Weekends’ opening: +50%

5.1.2 Researved desk: +100%

5.1.3 Private desk area: + 200%

5.2 On the basis of the usage plan, the Provider surcharges the User for the use of amenities as follows:

5.2.1 Printing, scanning and photocopying facilities: 0.05€ per page after the 3rd page

5.2.2 Short-throw projector, with chromecast and projector screen: +50%

5.2.3 46″ TV/screen for presentations, with built-in miracast: +50%

5.2.4 Video conferencing system (Meeting Owl): +50%

5.2.5 Laptop: +100%

5.2.6 Computer screen: +100%

5.2.7 Keyboard & mice: +25%

5.2.8 Personal locker: +25%

6. Access and Use:

6.1. Users, having paid the usage plans are granted access to the facilities and services during the operational hours as specified by the Provider on the official website.

6.2. Users are responsible for maintaining a clean and organized workspace, respecting shared areas, and complying with all safety and security protocols.

7. Conduct and Behaviour: 

7.1. Users will not attempt to gain any unauthorized access to any services, or accounts, systems or networks, through hacking, password mining or any other means. 

7.2 Users will not obtain or attempt to obtain any materials or information belonging to the Provider through any means not made available through the services offered.

7.3 Users will refrain from any illegal, immoral or unethical online activity, such as (but not limited to): downloading, uploading or streaming illegal files, accessing illegal sites, conducting illegal transactions, copyright infringement, phishing etc.

7.4 Overall Users will not use the facilities and services in any shape, form or purpose that is unlawful, prohibited, immoral, or unethical. 

7.5 Users agree to always conduct themselves in a professional and respectful manner while using the facilities and services.

7.6 Harassment, discrimination, and disruptive behavior will not be tolerated and may result in immediate suspension or termination of the usage.

8. Liability: 

8.1. The Provider is not liable for any damage, loss, or theft of personal property belonging to Users while using the facilities and services.

8.2. Users are responsible for their own belongings and should exercise caution to prevent any losses.

8.3 Users may be held responsible for any damage, loss, or theft of property, including intellectual property, caused to the Provider. 

8.4 Users will abstain from interfering with the Provider’s full use or access to the facilities and services.

9. Confidentiality:

9.1. Users are responsible for safeguarding their own confidential information and should not disclose sensitive information to others within the facilities or during the use of services, with the exception of the information legally and contractually required by the Provider to offer the services described.

9.2. The Provider is not responsible for any breaches of confidentiality by Users or third parties.

9.3 Users acknowledge and agree that during their presence in the facilities and use of the services, they may be exposed to confidential Information, including but not limited information about business, sales, operations, know-how, trade secrets, business affairs, any knowledge gained through examination or observation of or access to the facilities, computer systems and/or books, records and archives of the Provider, any analyses, compilations, studies or other documents prepared by the Provider. Such information should be kept in strict confidence, not used, directly or indirectly, and not disclosed to any third parties.

10. Limitation of warranty:

10.1 The Provider does not guarantee uninterrupted, timely, secure or error-free provision of services. The service and all products and services delivered to the User through the service are (except as expressly stated by the Provider) provided ‘as is’ and ‘as available’ for the User’s use, without any warranty, or conditions of any kind, either expressed or implied. 

10.2 In no case shall the Provider, its directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from the User’s use of any of the service or any products procured using the service, or for any other claim related in any way to the User’s use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.

11. Termination:

11.1. Users may terminate their usage plan after notifying the Provider.  

11.2. The Provider reserves the right to terminate or suspend a usage plan due to violation of the aforementioned terms and conditions or for any other reason deemed appropriate.

11.3 In any of the above mentioned cases, already paid fees are not refundable.

12. Amendments: 

12.1. The Provider reserves the right to modify these terms and conditions at any time. Amendments are effective from their public announcement on the Provider’s website.
